In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or our Services exceed the total amount paid by you to Jet's Kitchen in the six (6) month period immediately preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

OUR SERVICES AND ALL CONTENT, INFORMATION, AND MATERIALS CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, JET'S KITCHEN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

We do not warrant that: (a) our Services will be uninterrupted, timely, secure, or error-free; (b) the results obtained from use of the Services will be accurate or reliable; (c) the quality of any products, services, information, or other material obtained through the Services will meet your expectations; or (d) any errors in the Site or Services will be corrected.

12. Dispute Resolution

12.1 Informal Resolution

You agree to provide written notice of your dispute, and we will attempt to resolve the matter within thirty (30) days of receiving your notice. If the dispute is not resolved within this period, either party may proceed with formal dispute resolution as set forth below.

12.2 Binding Arbitration

Except as otherwise provided herein, any dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or your use of our Services that cannot be resolved informally shall be settled by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration body. The arbitration shall be conducted in English and shall take place in the United States at a location mutually agreed upon by the parties or, if no agreement can be reached, at a location determined by the arbitrator.

The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could order or grant, except that the arbitrator may not award punitive damages unless expressly provided by statute. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND JET'S KITCHEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Kitchen agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.

13. Term and Termination

These Terms are effective as of the date you first access or use our Services and shall remain in full force and effect for as long as you continue to use our Services or maintain an account with us, unless earlier terminated in accordance with this Section.
